Due diligence and a code of conduct are intertwined principles that guide the actions and decisions of certifiers. Through diligent investigation and adherence to ethical standards, certifiers ensure that their decisions are well-founded, compliant with regulations, and professional. By demonstrating these principles, certifiers contribute to the overall trustworthiness of their industry, safeguarding the interests of stakeholders and upholding the values of integrity and accountability.

Learning Outcomes:

At the end of this session, you will have an understanding of:

  • The risk of Registered Certifiers, being construction practitioners, sued by owners regarding Building Code breaches of combustible cladding installed on buildings 
  • The need for an alternative solution as an alternative performance based pathway for compliance under the Building Code
  • A NSW Court of Appeal decision in relation to the party that has the onus to show evidence of an alternative solution, the measure of damages and what this means for Certifiers
  • Why the lack of an alternative solution was a substantive breach and not just a minimised technical breach
  • The key focus areas on health and safety outcomes in modern high rise living
  • The Code of Conduct for NSW Certifiers and what this means in relation to due dilligence
  • Q& A session included

Justin  is a senior construction lawyer and pre-eminent building practitioner advocate. Justin’s practice is cross-jurisdictional having accepted briefs in Victoria, New South Wales, Queensland, and the Australian Capital Territory. Justin is an expert construction litigator, and highly experienced in medium to high dollar litigation building and commercial disputes. Justin gives quality regulatory and front end contractual advice.

Justin is presently Chairperson of the HIA Industrial Relations and Legal Services Committee, and a member of the Regional Executive Council, for HIA Victorian Chapter.
